City and HOA Approvals for Remodels in South Orange County

By Parham Shariat ·

A remodel in South Orange County usually needs two separate approvals. The city or county looks at safety and code. Your HOA looks at appearance and community rules. One does not replace the other, and each has its own paperwork and its own clock.

Step 1: find out who issues your permit

That depends on your address, not just your mailing city.

  • Rancho Santa Margarita is an incorporated city. Permits come from the city's Building and Safety Division at City Hall, 22112 El Paseo.
  • Coto de Caza, Ladera Ranch and Rancho Mission Viejo are unincorporated communities, so permits come from OC Development Services, the county office that handles permits and plan check for those areas. Applications can be made online through the county's myOC eServices portal.
  • Mission Viejo, Lake Forest, Laguna Niguel and other cities nearby each run their own building department.

Not sure which applies to you? Call the building department with your address or ask us. It takes a few minutes and saves a wrong turn.

Step 2: know what needs a permit

OC Development Services lists interior remodels such as kitchens, bathrooms and interior walls among the projects that typically need a building permit, along with electrical, plumbing and HVAC work. Purely cosmetic work such as paint usually does not. Rules differ between agencies, so ask before you assume.

It is tempting to skip the permit on a smaller job. Rancho Santa Margarita's own guidance warns that property insurers may not cover work done without permits and inspections, and that contractors who are not licensed for the work cannot obtain the permit in the first place.

Step 3: understand plan check and inspections

Plan check is the review that happens before construction. Reviewers look at the structural, architectural and fire safety parts of your plans. Then inspectors visit during the work. For kitchens and baths, rough plumbing, electrical and mechanical inspections happen before the walls are closed, which is one more reason the schedule matters.

A submittal that comes back with corrections costs you weeks. We cover how to avoid that in our article on city resubmittals.

Step 4: check your HOA

HOA approval is a separate process. Your community's CC&Rs and design guidelines list what needs approval, and California's Davis-Stirling Act sets the rules for how associations operate.

  • Exterior changes such as windows, doors, patio covers, additions and exterior colors almost always need approval
  • Interior work often does not, but changes to layout or structure may, especially in condos and townhomes
  • Contractor requirements may include a license, proof of insurance, and set work hours and days
  • Review time varies by association. Thirty days is common once your application is complete, so ask early
  • Starting without approval can lead to fines or an order to undo the work

If you live in a master planned community, you may have a master association and a neighborhood association. Ask whether you need approval from one or both.

Put it in order

  • Confirm which agency issues your permit
  • Ask your HOA for its checklist and application
  • Finish the design and have the trades review it
  • Submit to the HOA and the city, in whichever order each requires
  • Do not schedule demolition until both approvals are in hand

Each one will tell you what it needs to see. Ask for the checklist at the start, because the requirements and the order can differ.
